In my very first exposure to IT in early 1980’s, I experienced a small part of a large engineering company where raw data was keyed in by a team of female admin and submitted to a mainframe down in Stafford. If you were lucky you got a result four hours or longer later, if it wasn’t an ‘Abend’ (An abnormal end error message – technical but correctly spelt) probably due to strange data, or a comms issue down the very expensive leased line. If the mainframe was off-line or busy, your ‘job’ could not be submitted up the line sometimes for hours, maybe days.

Moving on in the late 80’s, t'internet was being imagined as a distributed network by Paul Baran and others, who originally worked to create a communication system that could withstand a nuclear attack by having no central point of control. This vision was a response to Cold War concerns about vulnerable, centralised phone lines and led to the development of ARPANET. The concept was a decentralised network designed to remain functional even if parts of it were destroyed. So far, so good.

Since the 2000’s as we know, we have seen the growth of most of our internet resources in far fewer hands. No more so than in the provision of Cloud storage and technology. This is now dominated by Amazon (AWS) approximately 30-32%, Microsoft Azure 20-23% and Google Cloud with around 11-13%. The dangers of concentration of so many eggs in so few baskets was brought home last week, as a AWS outage. We were told this was due to “a latent defect within the service’s automated DNS (domain name system) management system”. This was apparently down to an empty DNS record for the Virginia-based US-East-1 datacentre region. Well it certainly was a problem that affected many well beyond the US East Coast between the Atlantic Ocean and the Appalachian Mountains.

Around 2,000 organisations were affected including Banking sites (Lloyds/Halifax), HMRC, parts of the NHS (at least ten sites), DWP, Ring doorbells, Duolingo and Strava. “The Cloud” in this situation feels less good than my old friend the IBM mainframe situated in Stafford in the 1980’s. Its just a big computer in someone’s big shed ! Many organisations rely indirectly on AWS. This occurs through our partners, third-party services, or SaaS applications. How aware of this are we within our supply chain? Do we even ask about it in sufficient depth?

AWS storage and Agentic AI has been enthusiastically marketed within the socialhousing sector, non-profits and among other parts of the UK public sector. AWS is in use at quite a few HA’s, such as Aches Housing in Sheffield and Housing Plus Group, in Shropshire. 

One Social Housing Management System, is also currently being marketed, which operates behind AWS AppStream 2.0 as a means of browser delivery of a legacy solution. Users and residents of that one had an outage last week until around 10am on Monday, although could have been worse. Unless an ITT tender purchaser of a HMS had their wits about them, it could be easily sold as a modern browser solution, with the true platform being spotted much later. Always ask the right questions in procurement's, or have a Critical Friend along to help you do that and interpret the answers properly too!

While ‘lightning might not soon strike twice’, this shines a spotlight on the fragility of our supposedly smart technology. Amazon's massive AWS outage here, points to a key weakness in the modern internet. I have read multiple articles and listened to a tech podcast that basically took the view that ‘errors are understandable and inevitable for so-called “hyperscalers” ‘. It shows just how difficult it is, to prevent every single failure,

While no one I know really would like to return to multiple rooms of refrigerated tin, what is to be done going forward? What appetite might there be for the big three to work together to enable redundancy? Are organisations better looking for smaller alternatives or spreading their risk (with the downside of potential duplication and additional expense). 

The questions for management and their boards following this should include, “do we have good enough dependency mapping” also “have we effective business continuity planning” ? Does the potential fragility of our core storage choices make our organisation fragile too. In previous blogs I have shone a light on the tech beneath, another latent issue. 

Boards should consider specific due diligence regarding reliance on automated systems managed by the hyperscalers. If a latent defect in an automated process can bring down critical infrastructure affecting major banks, government services (HMRC, NHS, DWP), and consumer services, the question must be asked: What is the specific risk quantification tied to single points of failure within provider automation layers?

As the many Social Housing providers, Councils, Contractors or Care & Support providers I work with are aware, I tend to get involved in a whole raft of projects. Sometimes I am the Critical Friend that helps procure the right new right system/application solution. Other times its where organisations have heard from peers of how I have helped recover failed projects/procurements. It’s sad to see in the latter, often a lot of time, public money and energy wasted. My view is that its all generally potentially recoverable. It would be better if it never happened in the first place, of course!

I was chatting this week with an ICT colleague at an organisation this week, who looks after aspects of another linked enterprise. We were talking about how much is often taken on trust in software procurements. They knew the strict methodology I generally use, which clearly identifies ‘what’s there and what’s not’ from tenderers. Organisations new to software procurement often don’t know the core questions to ask or can get blindsided by good sales and little much detail underneath.

Often people in the organisation looking to procure, even if within OJEU (or OJUK I guess after our Brexit), structure a procurement where much is based on ‘how the tenderer might supply x or y’, rather than what’s there right now or not. Where suppliers know they cannot actually supply a big chunk of what’s being asked for, or it might be future development, good sales folk will no doubt reach to play the ‘Partnership Card’. Nothing really as cheesy, as a supplier/tenderer telling you, “We see ourselves as a partner, not a vendor”.

“We will work with you as a ‘unique partnership’ and we will build this together, respecting each other and the buyer having a special position in creating something moulded around your needs. You will be strategic, showcase partner”. Wow that sounds good. Have you ever been offered that?

“Partnership”, is a bit overused during procurement, particularly where there are elements missing.

At one two-day demonstration, for a full new Contractor, Housing Management, Mobile, CRM & Self-service system, one system supplier (I wont be as rude as to name them or my 19k home client in Gods Own County - Yorkshire), banged on about partnership, for a full ten minutes at the intro. So far so good, we soon launched into the demo proper and there was a question about some innovation around supporting my clients Universal Credit customers. The response was swift, “That would be a change request”, from the same Sales Manager that had done the intro.

My response was very swift too, (as soon I could slip a word in edgewise), in asking “Would that be most likely free for us”?

The predictable answer back was, “If that was new functionality, it most likely would be chargeable”.

I replied, “But if we were to be working in that partnership you just outlined ten minutes ago, I would have expected something better. What you could you do for us? Could it be almost free of charge?”. He came back and said, “You must be joking”, or words to that effect. I replied, “Well you started it mate”!

Marriage is often a very common partnership and that one is made legally binding and occasionally, “Til death do us part”. If a supplier is expecting us to trust they will supply the 40%+ of the missing solution needed, “as a partnership”, then lets get it incorporated into a contract too then?

If they are wary of entering into some legal milestones, I would be very concerned and it would look very much like another supplier with a more complete solution, may well better get your project on time, with all the requisite fundamentals supplied on time. Most likely that other supplier option may well be more expensive, although carry much lower risk of non-delivery.

Also, what price expense?

For example, £80k (for example), may well sound a lot more to pay upfront, but what if it prevented 18 months of additional delay, that prevented 12 staff not being able to do their jobs efficiently for over a year? That cost may well easily exceed the £80k, plus extra admin possibly needed to fill in the gaps. You are maybe beginning to see the dangers of (non-contractual) software supplier partnerships.

No one could have missed the change in employment landscape over the last ten years. So many people now no longer fit into the full, temporary, part-time employee business model, that all of parents would have recognised. In those structures, your tax and NI would be faithfully deducted for Her Excellent Majesties Revenue and Customs.

The rise of the gig economy and a lot of us now working independently for ourselves, as resulted in more flexible working patterns, where we invoice as companies and sort our own tax and NI out, via an (expensive) accountant. This can be evidenced by the latter, sprouting up on many high streets, in what used to be the video rental shop.

Within SocialHousing, the 1% rent cut and other factors has meant that many experienced staff took voluntary redundancy and went to being self-employed. In a few cases, I have been at someone’s leaving do one week, to be back working with them as they are back on similar pay, for just three (not five) days  work. Why wouldn’t you do that? For the organisation themselves, it’s probably a win-win, as from one budget a person’s salary has been saved (yay!), and consultancy payments probably come out of a completely different budget (yay!).

There have been past cases where individuals have worked ‘under contract’ so to speak, but to all intents and purposes, were really employees, in the eyes of HMRC. The perception that some interim managers and contractors, were not paying their fair whack of tax has been reinforced by “bad press”.  For example in the case of Ed Lester and the Students Loans  Company in 2012,  where he was Chief Executive but paid through a Personal Service Company.

Since 2000, a regulation called IR35 has been in place to determine if contractors, are in fact that or employees. If a contractor works too much in a particular place or does not work with a changing set of clients, there are a number of tests to determine your IR35 status.

From April 6th 2017, new Public Sector regulations are expected, which means that the client you are working for, is responsible for determining the IR35 status of the work that you do. Many might take the path of least resistance and revert to paying the contractor or interim, directly with NI & tax deducted. This might have tax implications for many. Transport For London, has already acted in this area.

As regular readers of this blog will be aware, I spend a fair bit of time up in Scotland, and a lot of it since 2014, doing work with housing consultants Arneil Johnston. Founded in 1996, for a couple of decades now, their very diverse team has provided quality consultancy services in housing, finance and ICT to the public sector in Scotland.

I was enormously pleased to be able to attend the AJ twentieth anniversary celebrations, at the Central Hotel in Glasgow, last Friday. Douglas and Jane, the original founders were at the event. It was great to raise a glass or two, of Prosecco to the team and it's fabulous work, right across Scotland. AJ have worked  with 97% of local authorities and 32% of RSLs, which is quite some record, for socialhousing.

I have really enjoyed my AJ work with such a wide variety of projects. Always something interesting and such a great team to work with. Donna Milton and Gillian Houston are always there with useful advice and direction. almost like the big sisters I never had. Projects I have been involved with, have taken me around the country, Dumfries & Galloway, Lanarkshire, Perth, Edinburgh and nearer Glasgow on Housing Options Toolkit delivery.

The latter project, I find particularly interesting and it was super, to chat again to Marion Gibbs of the Scottish Government Housing team, as well as others involved with delivery of 'Housing Options' across the country. Definitely a policy that should be considered right across the UK, linking Housing, Health and other factors, to reduce homelessness and better sustain tenancies. A multi-agency approach that I think Bevan would have recognised and endorsed, rather than the fragmented mess we appear to be drifting to, if we are not careful.

Alan McKnight had some great stories to share to all the clients, friends, contacts and family members who attended. I won't steal his thunder, but there were some road trip driving stories that raised a chuckle, (you will understand if you were there!). Life as a consultant is not all Jacuzzi's and Orkney real ale you know. I certainly will be catching up later this summer with Alan for a rematch over a curry.

I felt so very proud to be at Arneil Johnston's twentieth anniversary and to be working on ICT projects and general housing assignments with some ICT element, of which there are many, with the best. Great to be together with them, going forward in their third decade. I know we have some fascinating social housing ICT projects coming up. Can't wait, see you at the intro meeting, if you read this blog, do say hello 8-)
